Soto had been dozing on the beach the morning of Feb. 4, 2014, when the Long Beach Parks & Recreation pickup - a large Dodge Ram - ran Soto over.

According to the original complaint, Soto was asleep and didn't hear the approaching pickup. The driver did not see him on the beach, even though Soto was in a clear line of sight, and was distracted while behind the wheel.
