A Los Gatos, California, man died after being struck by a car in Truckee late last month. He was riding on his bicycle when the accident occurred. Several citizens witnessed the accident and were at the scene performing CPR on the man. He was transported to a local hospital for medical treatment, but was pronounced dead after arriving.
The man's death raises questions about wrongful death and civil liability for the driver who may have been responsible for the wreck.
The man is now being remembered as someone who was a great father and wonderful neighbor. People often thought he was much younger than he actually was because of the physical shape he was in. At the time of the accident, he and his family were on vacation in Truckee. He was reportedly out for a leisurely bike ride when he was struck by the car.
The victim and his family lived in their Los Gatos neighborhood for several years, and dozens of messages flooded a condolence board after his untimely passing.
It has yet to be reported whether a wrongful death suit or criminal charges are pending against the driver involved in the fatal collision.
California families who lost a loved one due to the apparent negligence of another may have legal options available allowing them to seek compensation against the responsible party. A wrongful death lawsuit can result in a monetary award to ease some of the financial brunt inevitable in a tragedy of this nature. To prevail, however, surviving family members have to prove that negligence caused a fatal accident.
